Court suspended the sentence hearing of Nongthombam Ajay, son of ex- minister of IFCD, CAF&PD and YAS, N. Biren Singh convicted on the charge of killing of Irom Rojer of Wangkhei Angom Leikai, Imphal on March 20.
Ajay was produced at the court of district session, Imphal West today in presence of the counsel of the CBI and the counsel of the accused. Following the a prayer from the defence counsel to release him on probation of good conduct under section 4 of the Offender Act 1958 which is read with 360 of the CrPC, the court fixed the date of sentence hearing on January 20.
The defence counsel drew the attention of the court to sub section (2) of section 4 and submits before taking any order under section (1) of section 4, the court shall take into consideration, if any, of the probation officer concerned in relation to the case and prayed for calling reports from the officer concerned prior to sentence hearing.
The CBI counsel committed that since the accused is convicted under section 27 of the Arms Act, the PO Act is not applicable and cited a case law—2013 Cril Law Journal 3538.
The court called the report from the probation officer for consideration with the final hearing.
The superintendent of the Central Jail Sajiwa was directed to produce the convict accused on January 20.
Irom Chitra, mother to deceased said, “I don’t believe that justice will be delivered as I wish. When one is shot by a gun, everyone knows what would happen in common sense. The M-20 pistol is not a gun which can be issued to a person like him. We have been facing continuous threats.”The hearing is again postponed today. We the parents have lost our lone son and at the same time we have been limitlessly suffering in this case, addded Chitra.
The court declared N. Ajay as convict on January 6.
Ajay shot Rojer to death on March 20, 2011 along the Airport Road in Imphal in a tussle along the road. Ajay surrendered to the police on March 25, 2011 along with an M-20 pistol with six live rounds of bullets. CBI had been investigating over the incident. Irom Rojer was 21 when he died while the accused Ajay was about 33 years of age.
